Якої реформи потребує поліція (погляд дилетанта)

Реформа Авакова-Деконаидзе не пройшла з двох причин. По-перше, їй завадив «закон аутопоезису», за яким структура завжди повертається до мети, для якої її створювали, — у випадку МВС України — це, в першу чергу, каральні та конвойні функції.
По-друге, їй завадив «закон сильної отрути», за яким домішка отрути до їжі робить останню непридатною для вживання, — хоча зовні, а також на смак та запахом, їжа здаватиметься безпечною.
Закони наче прості, але, чомусь, не всім зрозумілі. І тому варті прискіпливого вивчення.
Не можна створити будь-яку нову структуру, маючи правила прийняття та атестації персоналу старої. Це як ремонтувати сучасну автівку, використовуючи деталі кінної карети. Все закінчиться тим, що сучасний седан (універсал чи позашляховик) з рештою будуть тягнути коні із кучером на капоті.
Що може вчорашній «няшка-поліцейський» розповісти матьорому співробітнику ДАІ?.. А що оперу з із десятирічним досвідом роботи у міліцейському РУВС?.. Що хабарі брати не можна?.. Що не можна фальсифікувати кримінальні провадження?.. Щеня добермана, звісно, може спробувати повчити дорослу конвойну вівчарку. Але кінологам, переконаний, таких випадків ще не траплялося. До того ж повторюю, кадрові департаменти МВС лишилися незмінними. І на посаду підбирають співробітників за параметрами радянської міліції. І не важливо, як ця міліція називається, на чому їздить і у що одягнена.
Це ж правило у вульгарному середовищі промовляють простіше: «хто пані обідає, той її й танцює». Є, звісно, невеличка кореляція на місцевий менталітет, але вона не змінює ситуацію в цілому.
Що трапилося — зрозуміло. Розглянемо, що із цим робити
Насправді все просто — треба створювати паралельний правоохоронний орган. Буквально паралельний! Але з іншими «стартовими параметрами», як-то: системою освіти, системою звань та посад. З іншими правилами підбору персоналу. І з обовʼязковою, закріпленою статтею у Кримінальному кодексі України, забороною переходу зі «старої» поліції в «нову»! Доказ простий: перейшов у нову структуру зі старої — весь ланцюг цього рішення, разом із «перебіжчиком» отримує пʼять років позбавлення волі із довічною забороною обіймати посади у будь-яких державних силових, поліційних або спеціальних структурах. Ця стаття насправді ніколи не знадобиться. Її мета — бути запобіжником від зараження.
Як назвати структуру, що створюватиметься? Слово «поліція» вже використане. Можемо назвати її «варта» — близький за змістом український відповідник грецькому слову «πολιτεία».
Що робити із «міліцейською поліцією»
Нічого не робити. Взагалі нічого. Всі зарплати мають бути однакові із новоствореною структурою. Всі пенсії — однакові. Забезпечення — однакове. Її ліквідація має відбуватися за «рудиментарним принципом» — шляхом природного відмирання.
В міру приросту новоствореного органу, скорочується набір (!) до штату старого. Саме «набір до штату», а не «штатна чисельність», — не треба плутати ці поняття.
Що робити із вишами МВС? Теж нічого. Вони й зараз готують цивільних фахівців. Просто в міру створення нових навчальних центрів для Варти, скорочуватиметься набір на профільні факультети ВНЗ МВС. З рештою, вони стануть звичайними цивільними вищими навчальними закладами України. А щодо спецзвань викладачів, — хай будуть. І пенсії. І виплати за вислугу. Хай буде все, окрім права готувати фахівців для Варти.
«Є ж муніципальна варта», — хтось скаже. Так, є! А в інших країнах є ще муніципальна поліція. А у США є навіть шерифи, на додаток до поліції та муніципальної поліції й окремо «маршали». І у всіх різне підпорядкування. Але це працює.
Насправді є лише одне принципове питання, що потребує вирішення: що робити із вузькопрофільними підрозділами МВС, як-то УБОЗ, УБЕЗ, УБНОН та подібними. Питання непросте.
Щодо УБОЗ
УБОЗу в сучасних умовах мало повернути його попередній статус.
Допоки не завершено реформування, УБОЗ має набути потрійного (!) підпорядкування МВС, прокуратури та Мінюсту. А керівництво його має затверджуватися на рівні Президента України.
Чому так? А тому, що структура одразу створювалася, як спеціальний підрозділ карного розшуку по боротьбі з організованою злочинністю — т.зв «6-й відділ». І будемо чесні, при всіх своїх «пригодах» із завданням знищення бандугруповань УБОЗ впорався. У свій попередній стан, як підрозділ Варти, УБОЗ повернеться тільки після повного позбавлення корупційного впливу Міністерства внутрішніх справ. І процес цей може тривати до двадцяти пʼяти років! Але про це треба розписати окремо.
Щодо УБЕЗ
УБЕЗ це нащадок «відділів боротьби з розкраданнями соціалістичної власності», більше відомих під радянською абревіатурою «ОБХСС».
Туди, під час створення ще в часи пізнього СРСР, одразу підбирали співробітників не з апарату МВС, прокуратури чи держбезпеки. Часто брали звичайних інженерів, військових, яким додавали необхідної економічної та юридичної освіти. Відповідне має бути й реформування — вивести окремим управлінням (департаментом) із підпорядкуванням Нацбанку. Уявляєте спроможність олігархії втікати від податків, та домовлятися із податківцями, якщо Нацбанк матиме такий інструмент у своїй структурі? Те ж саме я б зробив з економічними підрозділами СБУ — «кашниками». Тільки підпорядкувати їх треба Мінфіну. І хай змагаються з УБЕЗ Нацбанку із Управлінням економічних розслідувань (УЕР) Мінфіну за звання «хто краще». І податківці, якщо їх підкорити Мінфіну теж почнуть працювати за фахом. Це буде не якесь «унікальне»законодавче нововведення, — щось подібне працює у США. Там навіть все гірше — там наш аналог УДО підпорядковано Мінфіну.
УБНОН….
Це має бути підрозділ Міністерства охорони здоровʼя.
З одного боку його повноваження мають бути розширено до боротьби із підробними ліками. З іншого (тут про наркотики) — саджати хворих за хворобу, це занадто. Тому оперативні функції треба залишити, а от слідчі дії мають бути у Поліції та Варти, за матеріалами УБНОН, МОЗ України. Можна навіть абревіатуру не міняти.
Решту підрозділів Поліції треба дублювати відповідними підрозділами Варти. І поступово заміщати. І триватиме це може до чверті століття. Тобто, може і раніше все станеться, але обрій планування має бути у двадцять пʼять років. І навіть якщо один, останній, співробітник поліції вирішить служити далі, до повної вислуги, то хай буде поліція у складі одного передпенсійного полісмена на фоні кількох десятків тисяч вартівців. Ми країна вільних людей, а Воля — це право рішення за умов відповідальності за нього.
Лишилося вирішити, що робити із самим Міністерством внутрішніх справ
Воно має лишити за собою:
-
сервісні функції забезпечення громадян та іноземців необхідними документами;
-
охорону майна громадян та підприємств;
-
рятувальні підрозділи (цивільний захист та пожежна охорона).
А як же Міністерство з надзвичайних ситуацій? А воно взагалі штучне! Це копія російського доробку під назвою «МЧС», створеного під теперішнього міністра оборони РФ Сергія Шойгу. В Україні це була корупційна годівничка для найближчого оточення перших президентів України Кравчука та Кучми. Обʼєднуючи МНС із МВС ми ліквідуємо зайве міністерство і повертаємо МВС функції, які воно повинно мати за своєю назвою і суттю.
На зауваження: «а от в інших країнах прикордонники із митниками навіть МВС підкоряються», є три простих заперечення. Так, там вони підкоряються, але…

Скільки з цих «інших» країн пережили: масові репресії, позасудові страти, державний бандитизм та масові вбивства громадян під час законних протестів проти свавілля посадовців?

Скільки країн пережили створення на базі підрозділів МВС окупаційних силових структур ворога?
-
У скількох країнах співробітники МВС передали у розпорядження ворожої армії стратегічні обʼєкти з атомними електростанціями включно?
МВС є структурою, яка не підлягає знищенню. І не може бути розформованою. Єдиний спосіб припинити свавілля її співробітників — максимально скоротити повноваження до рівня структури державного сервісу.

З усією повагою до автора, але Ваші уявлення та знання щодо системи МВС та розподілу функцій між правоохоронними органами в Україні неактуальні. «МНС» у нас немає, є ДСНС, яка підпорядкована МВС.
УБЕЗ, УБОЗ теж немає. Є Департамент стратегічних розслідувань НПУ. Левову частку повноважень УБЕЗ перебрало на себе БЕБ.
Далі. Хто буде вирішувати хто має право служити у Варті, а хто — ні? Закордонні експерти? Чи наші громадські активісти, які не те що і дня не працювали на державних посадах, так і взагалі уявлення не мають про кримінальну юстицію (базового знання законодавства)? Де буде та межа між «старим корупційним ментом» і «безневинним молодим поліцейським», адже далеко не всі співробітники поліції є «брудними». Є багато гідних людей і професіоналів. Їм теж буде закрита дорога в новий орган?
В іншому — згоден. Треба створювати все «з нуля».
Але також варто додати — без зміни сучасного КК та КПК — будь яка реформа поліції(в частині кримінального блоку) неможлива. Ці два документи — диверсія проросійських сил (парламентарів-агентів кремля) часів Кучми та Януковича.
